Maternal Glow Jewelry, LLC offers this website, including all information, tools and Services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here. 

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any Services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

Any new features or tools which are added to the current store shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and Services to you.

Due to the custom and detailed nature of our products, it is important that you fully understand these terms and conditions.

All sales are final and paid up front. Refunds are not permitted under any circumstances. You have a 24-hour window from the time of purchase to cancel your order; however, cancellations are subject to a 20% restocking fee. Please note that orders cannot be canceled or modified after this 24-hour period due to the immediate ordering of custom supplies to expedite turnaround times for our valued clients. Therefore, it is crucial to be entirely sure of your design elements and setting size and styles before completing your purchase. I strongly advise reviewing your order details thoroughly before finalizing your transaction. For further details, please refer to our refund policy.

Milk and inclusions are required to be sent in within six months from the date of purchase, but preferably as soon as possible. Failure to do so within the six month timeframe will result in an empty setting being sent to your provided address and a reinstatement fee of $45 + shipping if you wish to complete your keepsake in the future. Please note that we do not maintain a stock inventory of settings; each one is custom ordered and designed for each client.

Maternal Glow Jewelry, LLC is not responsible for items that are lost or damaged during shipment. That includes but not limited to the items being shipped from Maternal Glow Jewelry and client milk/inclusions that are lost or damaged in the mail.

SECTION 1 - ONLINE STORE TERMS
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.
You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).
You must not transmit any worms or viruses or any code of a destructive nature.
A breach or violation of any of the Terms will result in an immediate termination of your Services.

We reserve the right to refuse Service to anyone for any reason at any time.
You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the Service is provided, without express written permission by us.
The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

SECTION 3 - ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION
We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk.
This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site.

SECTION 4 - MODIFICATIONS TO THE SERVICE AND PRICES
Prices for our products are subject to change without notice.
We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.
We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

SECTION 5 - PRODUCTS OR SERVICES (if applicable)

We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any color will be accurate.
We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or Services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or Service made on this site is void where prohibited.
We do not warrant that the quality of any products, Services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

A. SENDING YOUR INCLUSIONS
Detailed and simple instructions on how to send your milk and/or inclusions will be sent via confirmation email once your purchase is complete. If you do not see the email in your inbox, check your spam folder. If you still cannot locate the email, please contact hello@maternalglowjewelry.com.

B. LOCAL DROP-OFF
If you live in the Orlando/Kissimmee FL area, you have the option to coordinate local drop-off/pick-up. Once your order has been placed, please respond to your order confirmation email to coordinate drop-off. Please do not drop-off your inclusions before confirming with me. Local orders are subject to the same turn around time, which begins the date inclusions are dropped off. Refunds for shipping costs on orders placed wishing to do local drop-off/pick-up instead, are completely in my discretion.

C. TURN AROUND TIMES
The typical processing timeframe for our breastmilk/keepsake jewelry ranges from four to twelve weeks starting from the date of receiving your breast milk, NOT from the order date. However, please note that this processing time is not guaranteed and may fluctuate based on the volume and intricacy of orders we are managing at the time. Rings, in particular, present additional challenges and may require up to 12 weeks or longer to complete, depending on factors such as the specific design, metal type, ring size, ect. Each ring is individually custom ordered according to your specifications, contributing to the extended processing time.

D. MILK/INCLUSIONS ARCHIVES
Preserved milk and leftover inclusions will be kept on-hand for 2 years from the date of purchase in case you would like to purchase an additional piece. Storing your excess milk is also helpful in case your jewelry becomes lost, damaged, or something happens to your jewelry otherwise and a replacement is ordered. Additional storage time may be available for purchase when your initial year is about to expire. Leftover cremation ash will always be sent back with your finished piece.

E. RETURNS AND EXCHANGES

F. CUSTOMIZATION
Orders are created to the exact customization determined by the individual customer during ordering. You will not receive a photo of your finished product prior to shipping. It is essential to address any customization inquiries before completing your order to ensure clarity on your preferences. Several stones might be created for select pieces, in which you will receive an email with proofs to select your desired stone. 

G. DESIGN PLACEMENT
There is no guarantee regarding the placement of hair, umbilical cord, ashes, placenta, additive flakes, ect. Hair, in particular, presents challenges in handling and may exhibit unpredictable placement. If specific placement or design preferences are not indicated, it will be left to the discretion of the artist.

H. ORDER CANCELLATION
You may cancel/make changes to your order via e-mail within 24 hours of placing it. Please note that a 20% restocking fee applies to all cancellations. We cannot accept changes or cancellations past the 24 hour mark. It is crucial to be 100% certain of your choices for stone design elements and setting size and style before placing an order. I strongly advise thoroughly reviewing your order details at checkout multiple before finalizing your transaction.

I. ORDER CHANGES
Requests to change order details must be completed via e-mail within 24 hours after purchase, as settings/supplies are promptly custom ordered. If I have already ordered the supplies/settings for your jewelry, an order change will not be accepted. I will inform you via email if your order qualifies for a change.

J. DISCOUNT CODES
Discount codes must be applied at checkout. Discounts cannot be honored after an order has been placed.

K. PRODUCT SAFETY
WARNING: CHOKING HAZARD. Our items are made for adults only. It is the client’s responsibility to keep out of reach of children and animals. We are not liable for any damages done if these items are not kept out of reach of children or broken by children/animals.

L. MATERIALS
All metals and supplies are stated in the product listing/description as our trusted supplier has stated to us.

M. RING SIZING
Our rings cannot be resized. The resizing process typically involves heating the ring, which poses a risk of heating the stone and potentially compromising its integrity, even causing it to melt. Therefore, obtaining the most accurate US ring size possible is crucial. We recommend visiting a jeweler or jewelry counter to be sized accurately. If you opt to have a jeweler attempt resizing, please be aware that it is at your own risk. Additionally, it's essential to acknowledge that due to the handmade nature of our products, ring sizes can vary by up to a quarter size above or below the specified size. While this difference is minor, it's worth noting.

N. ALLERGY DISCLAIMER
If you or the intended recipient of the jewelry has a documented allergy to metal or resin, it is advisable to seek advice from a medical professional before proceeding with a purchase. Our products are crafted from materials such as Stainless Steel, 925 Sterling Silver, 14K & 18K Solid Gold, gold plating, rhodium plating, and jewelers grade resin. Maternal Glow Jewelry, LLC cannot be held liable for any adverse physical reactions caused by our jewelry and does not offer refunds for items resulting from allergic reactions.

O. IMPERFECTIONS DISCLAIMER
We handcraft every piece of our breast milk jewelry without the aid of machines or mass production, the organic nature of handmade craftsmanship may result in certain imperfections being visible in your final piece. These imperfections could include small air bubbles within the stone, slight irregularities in the stone's edges, shape, color, or uneven distribution of flakes and design elements. Despite our best efforts to achieve perfection, these variations are a normal part of the handcrafting process and contribute to the individuality and charm of your breast milk jewelry. Each piece we create tells its own story, ensuring that no two pieces are alike.

P. JEWELRY CARE INSTRUCTIONS
Please handle your keepsake jewelry/items with ultimate care. Do not wear your jewelry while engaging in activities such as showering, bathing, exercising, sunbathing, swimming, or sleeping. Avoid exposing your jewelry to chemicals like lotion, perfume, hairspray, laundry or dish soap, as well as extreme temperatures, humidity, prolonged UV light, or essential oils. Keep your jewelry away from direct sunlight and humid environments, such as bathrooms. It is recommended to store your jewelry in a dark, dry area, preferably in a jewelry box, pouch, or small ziplock style bag with an anti-tarnish strip. Additionally, prevent mixing different metals together during storage, as this can accelerate tarnishing; for instance, avoid storing silver pieces alongside gold-plated items.

Q. TARNISHING AND PLATING STRIPPING
The metals in jewelry include Stainless Steel, 925 Sterling Silver, solid 14K & 18K Gold, gold vermeil, and gold and rhodium plating. Plated and vermeil pieces feature a coating that will naturally wear off and require re-plating eventually. The longevity of plating depends on several factors, such as individual body chemistry, frequency of wear, and proper jewelry care.

Local jewelry stores typically offer plating services for a small fee. For optimal results, we advise having the jeweler remove any keepsake stones before plating and set them again afterward.

Solid gold pieces are more durable and less likely to tarnish. They are better suited to be worn on a daily basis and be passed down as an heirloom for generations. 

Each jewelry order from us includes a polishing cloth, a storage box, and bag. While this cloth is suitable for polishing silver and solid gold pieces, we caution against frequent use on plated pieces and vermeil, as it may strip the plating over time.

R. PRODUCT PHOTOGRAPHY/VIDEOGRAPHY
Maternal Glow Jewelry, LLC reserves the right to photograph or take videos of any keepsakes that we make and use them in any way we choose. Including but not limited to promotional materials for our website, social media, marketing, etc. 

S. INTERNATIONAL ORDERS
The customer is responsible for costs associated with shipping inclusions with tracking to Maternal Glow Jewelry, LLC. All international orders are subject to a $10 handling fee. The customer is also responsible for any duties, taxes, or fees associated with receiving their package. Maternal Glow Jewelry, LLC will not be responsible for any duties, taxes, or fees. Customer should check their countries rules, regulations, and possible fees prior to ordering.

SECTION 6 - ACCURACY OF BILLING AND ACCOUNT INFORMATION
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

We may provide you with access to third-party tools over which we neither monitor nor have any control nor input.

Any use by you of the optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).
We may also, in the future, offer new Services and/or features through the website (including the release of new tools and resources). Such new features and/or Services shall also be subject to these Terms of Service.

We do not guarantee, represent or warrant that your use of our Service will be uninterrupted, timely, secure or error-free.
We do not warrant that the results that may be obtained from the use of the Service will be accurate or reliable.
You agree that from time to time we may remove the Service for indefinite periods of time or cancel the Service at any time, without notice to you.
You expressly agree that your use of, or inability to use, the Service is at your sole risk. The Service and all products and Services delivered to you through the Service are (except as expressly stated by us) provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.
In no case shall Maternal Glow Jewelry, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, Service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the Service or any products procured using the Service, or for any other claim related in any way to your use of the Service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the Service or any content (or product) posted, transmitted, or otherwise made available via the Service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

A. Due to the chemical properties of resin, discoloration can occur on ALL resin pieces. While we use high quality resin with UV stabilizers, no resin is able to 100% guard against damage and discoloration from harsh chemicals, heat and extended UV light. We provide a guarantee that no discoloration will occur to your stone within the first 3 months (90 days) after you receive your item. Any preservation issues resulting in discoloration would typically manifest within this initial 3-month period. Please remember that breastmilk varies in color, some may appear more yellow or even blue after preservation. If you would like to guarantee your stone is white, please select the “white” option during ordering.

 If your stone appears excessively translucent or yellow, I may opt to incorporate a small amount of brightener to enhance its appearance. If you prefer that I refrain from doing so, regardless of its translucency, please include a note with your order specifying your preference against brightener usage. Additionally, choosing the pearl shimmer option will subtly lighten the stone's hue. 

B. All keepsakes come with a 60-day warranty. If your keepsake discolors or becomes damaged due to natural causes, I will attempt to repair or provide a discount on another piece. Please email hello@maternalglowjewelry.com right away with high quality pictures/video that demonstrate the issue. You will need to cover the shipping costs for returning your piece and for shipping the repaired or new piece back to you. 

C. In the unlikely event that your breast milk stone falls out of your setting and you are able to locate the stone, we will repair it free of charge (ie. we will reset your stone for you into the original setting) within 60 days of you receiving your jewelry. After the 60 day mark we are happy to reset the stone into your setting for $45 plus the cost of shipping, provided that you ship your stone and setting to us. D. Maternal Glow Jewelry, LLC is not liable for breastmilk/inclusions that are lost or damaged due to accidents/events including but not limited to: robbery/theft, fire, flood, tornado, hurricane, earthquake, blizzard, or any other "Act of God".

E. Maternal Glow Jewelry, LLC is not responsible if your order was shipped to an incorrect address. Customers are expected to enter a correct shipping address at checkout.  We do our best to update shipping addresses for customers if they've moved, but cannot refund for incorrect shipments based on a new address.

F. Stone design elements such as crushed stone, flakes, and flowers, may result in a textured surface with micro bubbles, rather than a perfectly smooth finish. We cannot guarantee that any keepsake stone will appear "flawless."
 
SECTION 14 - INDEMNIFICATION
You agree to indemnify, defend and hold harmless Maternal Glow Jewelry, LLC and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, Service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

SECTION 15 - SEVERABILITY
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

SECTION 16 - TERMINATION
The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.
If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

SECTION 17 - ENTIRE AGREEMENT
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
These Terms of Service and any policies or operating rules posted by us on this site or in respect to the Service constitutes the entire agreement and understanding between you and us and governs your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).
